Terms and Conditions for CAKEDBYZENA


These Terms and Conditions govern the use of the services offered by CAKEDBYZENA ("we," "us," or "our") through our website at CAKEDBYZENA.COM  (the "Site"). By placing an order, the customer ("you") agrees to be bound by these terms.



1. Product Orders and Availability


1.1. Custom Orders: All custom cake and baked goods orders are subject to availability and our approval. Orders are not confirmed until we send a confirmation email and the required payment (deposit or full) has been received.

1.2. Design Interpretation: We strive to meet all design requests. However, creative interpretations may be necessary, especially for bespoke designs. While we will make every effort to match specific colors and inspirations, variations in shades, decorations, and overall look are possible due to the nature of food and ingredient availability. We do accept design inspiration images and reserve the right to deny a request if the cake design cannot be recreated. 


2. Pricing and Payment


2.1. Pricing: All prices are listed in AUD and are subject to change without prior notice, except for confirmed orders. Prices do not include delivery charges unless otherwise stated.

2.2. Deposits and Final Payment: All custom cake orders require a non-refundable deposit of 30% of the total amount to secure the order date. * The remaining balance is due 7 DAYS prior to the scheduled collection or delivery date. * For orders placed within 7 DAYS  of the date, full payment is required immediately.

2.3. Payment Methods: We accept payment via MasterCard, PayPal & Bank Transfer 



3. Order Changes, Cancellations, and Refunds


3.1. Changes: Minor changes to the size, flavour, or design may be requested up to 7 DAYS before the fulfillment date, subject to our approval and an additional charge. Changes cannot be guaranteed after this period.

3.2. Cancellations: - All requests for cancellations must be made in writing via email.

If you need to postpone your event, please contact us with via email with AT LEAST 10 days notice. Please note that your new date may not be available. If your new date is available, all monies paid will be transferred to the new date.

 

Cancellations made MORE THAN 7 DAYS before the fulfilment date will receive a refund of the amount paid, minus the non-refundable deposit (30%). * Cancellations made 7 days or less before the fulfillment date will forfeit the entire deposit and any payment made.

3.3. Quality and Satisfaction: Due to the perishable nature of our products, we do not offer refunds or replacements unless the product is damaged or defective upon collection or delivery. Claims must be reported within 4 HOURS of receipt, accompanied by photographic evidence. Dissatisfaction with flavour or cosmetic elements that meet the agreed-upon design does not qualify for a refund.



4. Collection and Delivery


4.1. Collection: If you choose to collect your order, you assume all responsibility for the cake or goods once they have left our premises. We are not liable for any damage that occurs during transportation.

4.2. Delivery: * Delivery is available within Sydney Metro for an additional fee. * The customer is responsible for providing the correct delivery address and ensuring someone is available to receive the goods during the agreed-upon time window. * If no one is available, the product may be left in a safe location at the customer's risk, or returned to our premises. A redelivery fee will apply for the latter.

Deliveries are between Tuesday - Saturday 9am-7pm and Sunday 9am-2pm on the date requested. We are unable to specify an exact time for delivery as all delivery drivers must follow a specific route to deliver all cakes on the day requested. We are unable to prioritise any delivery addresses.


5. Product Care and Liability


5.1. Product Care: Cakes and baked goods must be stored according to our instructions, usually in a cool, dry environment, away from direct sunlight and heat. We are not responsible for damage that occurs after the order has been delivered or collected due to improper storage, heat exposure, or incorrect handling.

5.2. Serving Size: All serving sizes described are DESSERT SERVINGS (2 INCH X 2 INCH X 1 INCH) .
